Energy Usage Information Policy and Notice

Effective Date: December 6, 2023

The Services of OhmConnect, Inc. and its affiliates (“OhmConnect”), which include our demand response program and energy management services that are described in the Terms of Service, are designed to use Energy Usage Data that you authorize your electric utility to share with OhmConnect. This Policy and Notice is intended to inform California residents about how OhmConnect accesses, uses and discloses your Energy Usage Data.

Definitions

Energy Usage Data means any usage information obtained through the use of your electric utility’s Advanced Metering Infrastructure (AMI), including your “smart meter”, when associated with any information that can reasonably be used to identify an individual, family, household, residence, or non-residential customer.

Third Party means any party other than OhmConnect, including any vendor, agent, contractor, or affiliate that provides service to or on behalf of OhmConnect or with whom OhmConnect engages directly or indirectly in the course of its business.

You means any OhmConnect user or member who has authorized their electric utility to share Energy Usage Data with OhmConnect.

Types of Energy Usage Data We Access

In order to provide you with the benefits of the Services, OhmConnect accesses the following types of Energy Usage Data that it receives from your electric utility:

We may use your Energy Usage Data for the following purposes:

With Whom We Share Your Energy Usage Data

In furtherance of the purposes listed above regarding how we use Energy Usage Data, we may share your Energy Usage Data with the following parties:

Utilities:
We may share your electric utility records and other account information with your electric utility if you direct us to disenroll you from your electric utility’s demand response program so that you can use our Services or if revoke your authorization for your electric utility to share your Energy Usage Data with OhmConnect.

Law Enforcement and In Connection with Legal Process:
We may share your electric utility records and other account information to identify, contact, investigate, or bring legal action regarding injury or interference with the rights and property of OhmConnect or its affiliates or to respond to lawful subpoenas, warrants, court orders, or other regulatory or law enforcement requests, but only when we believe in good faith that we are lawfully authorized or required to do so and when such Energy Usage Data is relevant to the request.

Additional Information About our Energy Usage Data Sharing Practices

‍Sharing of Aggregated or De-Identified Data:
We may share aggregated, anonymized or non-customer specific / de-identified Energy Usage Data at our discretion, including with Third Party marketing agencies and analytics providers or public entities, such as the California Public Utilities Commission, the California Energy Commission, or the California Independent System Operator to evaluate Energy Usage Data, to measure the amount of electricity saved through OhmConnect’s Services, or in response to a request.

Combination of Information:
We may combine Energy Usage Data with other information we obtain from our business records or your use of the Services.

Change of Ownership or Corporate Organization:
We may transfer to a Third Party or its affiliates or service providers some or all of your Energy Usage Data in connection with, or during negotiations of, any merger, acquisition, sale of assets or any line of business, change in ownership control, or financing transaction. We cannot promise that an acquiring party or the merged entity will have the same privacy practices or treat your Energy Usage Data as described in this Policy and Notice.

Your Rights Regarding Your Energy Usage Data 

You have the right to revoke your authorization for your electric utility to share your Energy Usage Data with OhmConnect at any time. 

Retention

We retain your Energy Usage Data as long as reasonably necessary based on legal requirements and recommendations, and as long as required to accomplish our legitimate business purposes, in accordance with federal, state, and local laws.

Security

We are committed to maintaining the security of the data you provide us. We use reasonable organizational, technical and administrative measures to protect your Energy Usage Data that we maintain. While we use these precautions to safeguard your Energy Usage Data, unfortunately, no data transmission over the internet or storage system can be guaranteed to be 100% secure. 

Updates to this Policy and Notice

We may change this Policy and Notice from time to time. The Effective Date at the top of this page indicates when this Policy and Notice was last revised. We may also notify you in other ways from time to time about how we access, use and disclose your Energy Usage Data described in this Policy and Notice.
