This page describes the terms and conditions (“Offer Terms”) that apply to OhmConnect’s Smart Device Offer (referred to in these terms and conditions as the “Promotion”). Open to electric service customers of California utilities PG&E, SCE and SDG&E, and New York utility Con Edison, all as further described below.
PLEASE READ THESE OFFER TERMS CAREFULLY AND IN FULL. THEY CONTAIN CONDITIONS AND RESTRICTIONS ON THE PROMOTION AND INFORMATION ON WHAT HAPPENS IF YOU FAIL TO SATISFY THE OHMCONNECT REGISTRATION PROCESS AFTER RECEIVING YOUR SELECTED SMART DEVICE, INCLUDING WHEN YOU CAN BE CHARGED THE FULL MSRP PRICE OF THE SMART DEVICE PLUS APPLICABLE SALES TAX IF YOU FAIL TO TIMELY CONNECT THE SMART DEVICE TO OHMCONNECT WITHIN THE PERIOD SPECIFIED.
OhmConnect is a free service that can help consumers decrease energy usage during periods of high demand. OhmConnect, Inc. (“OhmConnect”) has partnered with Google and several other smart device manufacturers to offer one free smart plug or a smart thermostat at the discounted price of $38.99 to customers who join OhmConnect and authorize their utility usage data to be shared with OhmConnect. You must be a new OhmConnect customer and enroll in OhmConnect’s demand response program to be eligible to participate in the Promotion. Limit one per participating household.
If you select the smart plug or smart thermostat, you also must connect your smart device to OhmConnect within 30 days of delivery or you will be charged the full purchase price for your selected smart plug or smart thermostat plus applicable sales tax (less amount already paid).
If you select the smart plug or smart thermostat, the smart device may require your agreement to other terms and conditions between you and the manufacturer or licensor of that smart plug or smart thermostat.
These Offer Terms incorporate by reference the additional terms and conditions corresponding to OhmConnect’s demand response program and, for those who are eligible for and elect to receive a discount on a Google Nest thermostat, Google’s Nest Rush Hour Rewards Program, both of which can be found here:
These Offer Terms are meant to be consistent with and supplementary to the Terms of Service, the Nest Rush Hour Rewards Terms, and any other terms imposed by the smart device manufacturers or licensors of the smart device (as applicable). In the event of any inconsistency or direct conflict between these Offer Terms and the Terms of Service or any other additional terms, these Offer Terms will prevail.
Subject to availability, OhmConnect will provide each individual who satisfies the eligibility requirements between October 13, 2022 at 12:01 AM Pacific Time (PT) and March 31, 2024 at 11:59 PM (PT) (the “Promotional Period”), including enrolling in OhmConnect’s demand response program, authorizing your utility usage data to be shared with OhmConnect and becoming an active OhmConnect user within 30 days of creating your OhmConnect account. If you select the free smart plug or smart thermostat, you must connect the device to your OhmConnect account within 30 days of delivery of your smart device. The available smart plugs are either one (1) OhmPlug or one (1) TP-Link smart plug. The available smart thermostat at the discounted price of $38.99 plus applicable sales tax is either (a) a Google Nest thermostat, (b) an ecobee3 lite thermostat, or (c) a Sensi smart thermostat. While supplies last.The Promotion cannot be combined with any other OhmConnect promotions or offerings. OhmConnect reserves the right, at its sole discretion, to suspend, modify or terminate the Promotion for any reason or for no reason. All information collected by OhmConnect in connection with the Promotion will be collected and used in accordance with the Privacy Policy.
To be eligible for the Promotion, you must satisfy all of the following conditions and steps:
To reserve your one free smart plug or a discounted smart thermostat, you must satisfy steps 1-6 within 30 days of creating your OhmConnect account. Also, you must satisfy step 7 within 30 days of delivery of your smart device.
Step 1:
Set up an OhmConnect Account. Participants must become first time, fully enrolled customers of OhmConnect. Visit ohmconnect.com and create a new OhmConnect account by providing your email address, zip code, first name, phone number (optional) and creating a password. To become an OhmConnect customer, you must agree to the Terms of Service.
Step 2:
Authorize Your Utility to Share Usage Data. As part of enrolling in OhmConnect’s demand response program, as well as to be eligible for this Promotion, Participants must authorize utility usage data to be shared with OhmConnect.
Before proceeding to Step 3 or 4 (as applicable), your utility (PG&E, SCE, SDG&E or Con Edison) must confirm that sharing has been authorized. Depending on your utility’s authorization process, this may take anywhere from 2 minutes to several weeks, although the average time is approximately 10 minutes.
Step 3 (only for those choosing a Google Nest thermostat):
If you opt to receive a discounted Google Nest thermostat, join Google Nest’s Rush Hour Rewards Program. Enrollment in both the OhmConnect demand response program and Google Nest's Rush Hour Rewards Program is required. This Step 3 is not required if you opt for a smart plug or other smart thermostat.
Step 4:
Provide a Credit Card. To receive a smart device, you must furnish OhmConnect with a valid credit card and provide your authorization for OhmConnect to charge your card for the full MSRP listed in Step 7 for the smart plug or smart thermostat you elect to receive plus applicable sales tax. We will not charge your credit card anything at this step if you choose a free smart plug; we will charge your credit card $38.99 plus applicable sales tax if you choose a discounted smart thermostat. You will be charged the full MSRP plus sales tax if you fail to connect the smart plug or smart thermostat to OhmConnect within 30 days of delivery of the smart plug or smart thermostat to the shipping address provided in Step 5 (less amount already paid). Step 5:
Provide Shipping Address. Provide a shipping address to where the smart plug or smart thermostat will be shipped. Please note that it may take up to 30 days to ship the item. OhmConnect is not responsible for delays caused by third-party shipping companies.
Step 6:
Become an Active User. You must complete a qualifying activity to become an active user before the end of the Promotional Period and within 30 days of creating an OhmConnect account. A "qualifying activity" means (a) logging into your OhmConnect account, (b) purchasing an item from the OhmConnect store, (c) connecting a new device to OhmConnect's demand response program for the first time, or (d) inviting new members to join OhmConnect's demand response program.
Step 7:
Connect Your Smart Plug or Smart Thermostat: You must connect the new smart plug or smart thermostat to your OhmConnect account within 30 days of delivery or we will charge your credit card for the full MSRP of the smart device delivered to you plus applicable sales tax (less amount already paid).
You are solely responsible for purchasing, maintaining and using at your own expense all utility, Wi-Fi, access to the internet, communications and other equipment and devices necessary to participate in the Promotion.
Employees, officers and directors of OhmConnect, its parent, subsidiaries, and affiliated companies, advertising, promotion, and production agencies, Webmasters and Web suppliers, their immediate family members (parents, grandparents, children, siblings, and spouse of any of the foregoing) regardless of where they live and individuals residing in their same household, whether related or not, are not eligible to participate in the Promotion.
Any fraudulent, deceptive or illegal activity, including using automated, robotic methods of online participation, and tampering with or abusing any aspect of the Promotion, as determined by OhmConnect in its sole discretion, will result in disqualification from the Promotion. OhmConnect may also prosecute such persons to the full extent of the law.
From time to time, OhmConnect may change these Offer Terms. If it does so, the “Last Updated” line above will be revised. You are responsible for regularly reviewing these Offer Terms. Your continued participation in the Promotion following the posting of changes to the Offer Terms indicates your acceptance of those changes. OhmConnect also reserves the right at its sole discretion to suspend, modify or terminate the Promotion for any reason or for no reason.
