This page describes the terms and conditions (“Offer Terms”) that apply to OhmConnect’s Sensi Smart Thermostat Offer (referred to in these terms and conditions as the “Sensi Device Promotion” or the “Promotion”).
PLEASE READ THESE OFFER TERMS CAREFULLY AND IN FULL. THEY CONTAIN CONDITIONS AND RESTRICTIONS ON THE SENSI DEVICE PROMOTION AS WELL AS INFORMATION ON WHAT HAPPENS IF YOU FAIL TO COMPLETE THE OHMCONNECT REGISTRATION PROCESS AFTER RECEIVING YOUR SMART THERMOSTAT, INCLUDING WHEN YOU CAN BE CHARGED FOR THE FULL PRICE OF THE SMART DEVICE PLUS APPLICABLE TAX (LESS AMOUNT ALREADY PAID) IF YOU FAIL TO TIMELY CONNECT THE DEVICE TO OHMCONNECT WITHIN THE PERIOD SPECIFIED.
OhmConnect is a free service that can help consumers decrease energy usage during periods of high demand. OhmConnect, Inc. (“OhmConnect”) has partnered with Sensi to offer $29.99 smart thermostats as part of the Sensi Device Promotion to existing electric service customers who are new to OhmConnect. You must be a new OhmConnect customer and enroll in OhmConnect’s demand response program to be eligible to participate in the Sensi Device Promotion participants are referred to in these Terms and Conditions as “Participants. Use of your selected smart device may require your agreement to other terms and conditions between you and the manufacturer or licensor of that smart device. Regardless, you must be a new OhmConnect customer and enrolled in OhmConnect’s demand response program to be eligible to participate in the Sensi Device Promotion.
These Offer Terms are meant to be consistent with and supplementary to the General Terms. In the event of any inconsistency or direct conflict between these Offer Terms and the General Terms, these Offer Terms will prevail.
Subject to availability, OhmConnect will provide a Sensi smart thermostat at the discounted price of $29.99 plus applicable sales tax to each participant who completes the eligibility requirements between May 11, 2023, at 12:00 AM Pacific Time (PT) to June 30, 2024 at 11:59 PM (PT) (the “Promotional Period”), including enrolling in OhmConnect’s demand response program, authorizing your utility usage data to be shared with OhmConnect and becoming an active OhmConnect user within 30 days of creating your OhmConnect account.
The Sensi Device Promotion cannot be combined with any other OhmConnect promotions or offerings. OhmConnect reserves the right, at its sole discretion, to suspend, modify or terminate the Sensi Device Promotion for any reason or for no reason. All information collected by OhmConnect in connection with the Sensi Device Promotion will be collected and used in accordance with the Privacy Policy.
To be eligible for the Promotion, you must satisfy all of the following conditions and steps:
To reserve your discounted smart device, you must complete steps 1-5 on or before June 30, 2024, at 11:59 PM Pacific Time and within 30 days of creating your OhmConnect account. Also, you must satisfy step 5 within 30 days of delivery of your smart thermostat.
Step 1:
Set up an OhmConnect Account. Participants must become first time, fully enrolled customers of OhmConnect. To do so, visit the offer page https://partners.ohmconnect.com/sensi-ca-ny/sensi-2999 and create a new OhmConnect account by providing your email address, zip code, first name, and phone number and creating a password. To become an OhmConnect customer, you must agree to the OhmConnect General Terms.
Step 2:
Authorize Your Utility to Share Usage Data. As part of enrolling in OhmConnect’s Demand Response Program, as well as to be eligible for this Promotion, Participants must authorize their utility usage data to be shared with OhmConnect.
Before proceeding to Step 3, your utility (SCE, SDG&E, PG&E or Con Edison) must confirm that sharing has been authorized. Depending on your utility’s authorization process, this may take anywhere from 2 minutes to several weeks, although the average time is approximately 10 minutes.
Step 3:
Provide a Credit Card. You must furnish OhmConnect with a valid credit card and provide your authorization for us to charge your card for the MSRP of the smart device. At this step, we will charge your credit card $29.99 for the smart thermostat plus applicable sales tax, which will be calculated after you provide your shipping address in Step 4. You will be charged the full MSRP (less the $29.99 amount and sales tax already paid) if you fail to connect the smart device to OhmConnect within 30 days of delivery of the smart device to the shipping address provided in Step 5.
Step 4:
Provide Shipping Address. Provide a shipping address to where the smart thermostat will be shipped. Please note that it may take up to 30 days to ship the item. OhmConnect is not responsible for delays caused by third-party shipping companies.
Step 5:
Become an Active OhmConnect User: You must complete a qualifying activity to become an active user before the end of the Promotional period and within 30 days of creating your OhmConnect account. A “qualifying activity” means: (a) logging into your OhmConnect account, (b) purchasing an item from the OhmConnect store, (c) connecting a new device to OhmConnect’s demand response program for the first time, or (d) inviting new members to join OhmConnect’s demand response program.
Step 6:
Connect Your Smart Thermostat: You must connect it to your OhmConnect account within 30 days of delivery or we will charge your credit card for the full MSRP of the smart device delivered to you plus applicable sales tax (less amount already paid).
You are solely responsible for purchasing, maintaining and using at your own expense all utility, Wi-Fi, access to the internet, communications and other equipment and devices necessary to participate in the Promotion.
Employees, officers and directors of OhmConnect, its parent, subsidiaries, and affiliated companies, advertising, promotion, and production agencies, Webmasters and Web suppliers, their immediate family members (parents, grandparents, children, siblings, and spouse of any of the foregoing) regardless of where they live and individuals residing in their same household, whether related or not, are not eligible to participate in the Promotion.
Use of automated, robotic, programmed and like methods of online participation are prohibited. Persons who tamper with or abuse any aspect of the Promotion, as determined by OhmConnect in its sole discretion, will be disqualified from participation in the promotion. OhmConnect may also prosecute such persons to the full extent of the law.
From time to time, OhmConnect may change these Offer Terms. If it does so, the “Last Updated” line above will be revised. You are responsible for regularly reviewing these Offer Terms. Your continued participation in the Promotion following the posting of changes to the Offer Terms indicates your acceptance of those changes. OhmConnect also reserves the right at its sole discretion to suspend, modify or terminate the Promotion for any reason or for no reason.
