This page describes the terms and conditions (“Offer Terms”) that apply to OhmConnect’s free Smart Thermostat Offer (referred to in these terms and conditions as the “Smart Thermostat Promotion” or the “Promotion”).
The Smart Thermostat Promotion is open to California residents who:
PLEASE READ THESE OFFER TERMS CAREFULLY AND IN FULL. THEY CONTAIN CONDITIONS AND RESTRICTIONS ON THE PROMOTION AND INFORMATION ON WHAT HAPPENS IF YOU FAIL TO SATISFY THE OHMCONNECT REGISTRATION PROCESS AFTER RECEIVING YOUR SMART THERMOSTAT, INCLUDING WHEN YOU CAN BE CHARGED FOR THE PRICE OF THE SMART THERMOSTAT PLUS APPLICABLE TAX IF YOU FAIL TO CONNECT THE SMART THERMOSTAT TO OHMCONNECT WITHIN THE PERIOD SPECIFIED.
OhmConnect is a free service that can help consumers decrease energy usage during periods of high demand. OhmConnect, Inc. (“OhmConnect”) is offering a free smart thermostat to PG&E and SDG&E electric service customers who join OhmConnect’s demand response program. Smart Thermostat Promotion participants are referred to in these Terms and Conditions as “Participants.” As part of this promotion, OhmConnect may administer a rebate of up to $75 that has been authorized by the California Public Utilities Commission (“CPUC”). Limit one per participating household. You also must connect your smart thermostat to OhmConnect within 30 days of delivery or you will be charged the full purchase price of the smart thermostat plus applicable sales tax.
For those electing to receive a Nest Thermostat as part of the Smart Thermostat Promotion, the OhmConnect demand response program is provided in conjunction with Google’s Nest Rush Hour Rewards Program, and enrollment in both is required to qualify for a free Nest Thermostat. If you opt for a smart thermostat other than a Nest thermostat, such smart thermostat may require your agreement to other terms and conditions between you and the manufacturer or licensor of that smart thermostat. Regardless, in addition to the other eligibility requirements described herein, you must be an OhmConnect customer and enrolled in OhmConnect’s demand response program to be eligible to participate in the Smart Thermostat Promotion.
These Offer Terms for the Promotion incorporate by reference the additional terms and conditions corresponding to OhmConnect’s demand response program, which can be found here:
The Promotion is provided in conjunction with Google’s Rush Hour Rewards Program, and enrollment in both is required to qualify for a free Google Nest Hub.
These Offer Terms are meant to be consistent with and supplementary to the General Terms and the Nest Terms (as applicable). In the event of any inconsistency or direct conflict between these Offer Terms and the General Terms, these Offer Terms will prevail.
Subject to availability, OhmConnect will provide each Participant who completes the eligibility requirements between June 9, 2022 at 12:00 AM Pacific Time (PT) and December 31, 2023 at 11:59 PM (PT) (the “Promotional Period”), including enrolling in OhmConnect’s demand response program, authorizing your utility usage data to be shared with OhmConnect and becoming an active OhmConnect user within 30 days of creating your OhmConnect account. The available smart thermostats are the following: (a) a Google Nest Thermostat, (b) an ecobee3 lite thermostat, or (c) a Sensi smart thermostat. While supplies last. OhmConnect may administer a CPUC rebate of up to $75 as part of this Promotion, which will be claimed for an eligible Participant by OhmConnect.
The Smart Thermostat Promotion cannot be combined with any other OhmConnect promotions or offerings. OhmConnect reserves the right, at its sole discretion, to suspend, modify or terminate the Smart Thermostat Promotion for any reason or for no reason. All information collected by OhmConnect in connection with the Smart Thermostat Promotion will be collected and used in accordance with the Privacy Policy.
To be eligible for the Promotion, you must satisfy all of the following conditions and steps:
To reserve your free smart thermostat, you must satisfy steps 1-7 on or before December 31, 2023, at 11:59 PM PT and within 30 days of creating your OhmConnect account. Also, you must satisfy step 7 within 30 days of delivery of your smart thermostat.
Step 1 (if you are not already an OhmConnect member):
Set up an OhmConnect Account. Participants must be a fully enrolled customer of OhmConnect, Inc. To do so, visit the OhmConnect offer page and create a new OhmConnect account by providing your email address, zip code, first name, and phone number and creating a password. To become an OhmConnect customer, you must agree to the OhmConnect Terms of Service.
Step 2 (if you have not already authorized sharing of utility usage data):
Authorize Your Utility to Share Usage Data. As part of enrolling in OhmConnect’s demand response program, as well as to be eligible for this Promotion, you must authorize your utility usage data to be shared with OhmConnect.
Before proceeding to Step 3 or 4 (as applicable), your utility (PG&E or SDG&E) must confirm that sharing has been authorized. Depending on your utility’s authorization process, this may take anywhere from 2 minutes to several weeks, although the average time is approximately 10 minutes.
Step 3 (only for those choosing a Google Nest Thermostat):
Join Google Nest’s Rush Hour Rewards Program: If you opt to receive a Google Nest Thermostat, join Google Nest’s Rush Hour Rewards Program. Enrollment in both the OhmConnect Demand Response Program and Google’s Rush Hour Rewards Program is required. This Step 3 is not required if you opt for another smart thermostat.
Step 4:
Purchase a qualifying smart thermostat from OhmConnect. You must furnish OhmConnect with a valid credit card to receive the free smart thermostat and provide your authorization for us to charge your card for the full MSRP of the smart thermostat (plus applicable sales tax) you elect to receive. You will be charged the full MSRP (plus applicable sales tax) only if you fail to connect the smart thermostat to OhmConnect within 30 days of delivery of the smart thermostat to the shipping address provided in Step 5. See below for MSRP.
Step 5:
Provide Shipping Address. Provide a shipping address to where the smart thermostat will be shipped.
Step 6:
Connect the Smart Thermostat. You must connect the smart thermostat to OhmConnect within 30 days of delivery of the smart thermostat to the shipping address provided in Step 5.
Step 7:
Become an Active OhmConnect User: You must complete a qualifying activity to become an active user before the end of the Promotional Period and within 30 days of creating your OhmConnect account. A “qualifying activity” means: (a) logging into your OhmConnect account, (b) purchasing an item from the OhmConnect store, (c) connecting a new device to OhmConnect’s demand response program for the first time, or (d) inviting new members to join OhmConnect’s demand response program.
By participating in this promotion, you represent and warrant that you have not received a thermostat incentive or rebate or free thermostat paid for by California ratepayer funds in the prior 7.5 years.
You are solely responsible for purchasing, maintaining and using at your own expense all utility, Wi-Fi, access to the internet, communications and other equipment and devices necessary to participate in the Promotion.
Employees, officers and directors of OhmConnect, its parent, subsidiaries, and affiliated companies, advertising, promotion, and production agencies, Webmasters and Web suppliers, their immediate family members (parents, grandparents, children, siblings, and spouse of any of the foregoing) regardless of where they live and individuals residing in their same household, whether related or not, are not eligible to participate in the Promotion.
Use of automated, robotic, programmed and like methods of online participation are prohibited. Persons who tamper with or abuse any aspect of the Promotion, as determined by OhmConnect in its sole discretion, will be disqualified from participation in the promotion. OhmConnect may also prosecute such persons to the full extent of the law.
From time to time, OhmConnect may change these Offer Terms. If it does so, the “Last Updated” line above will be revised. You are responsible for regularly reviewing these Offer Terms. Your continued participation in the Promotion following the posting of changes to the Offer Terms indicates your acceptance of those changes. OhmConnect also reserves the right at its sole discretion to suspend, modify or terminate the Promotion for any reason or for no reason.
