This page describes the terms and conditions (“Offer Terms”) that apply to OhmConnect’s discounted smart plug offer (referred to in these terms and conditions as the “Promotion”). Except where prohibited by applicable law, ALL SALES ARE FINAL.
PLEASE READ THESE OFFER TERMS CAREFULLY AND IN FULL. THEY CONTAIN CONDITIONS AND RESTRICTIONS ON THE PROMOTION AS WELL AS INFORMATION ON WHAT HAPPENS IF YOU FAIL TO COMPLETE THE OHMCONNECT REGISTRATION PROCESS, INCLUDING WHEN YOU CAN BE CHARGED FOR THE FULL PRICE OF THE SMART PLUG PLUS APPLICABLE TAX IF YOU FAIL TO TIMELY CONNECT THE SMART PLUG TO OHMCONNECT WITHIN THE PERIOD SPECIFIED.
OhmConnect is a free service that can help consumers decrease energy usage during periods of high demand. OhmConnect, Inc. (“OhmConnect”) is offering a discounted $9.99 smart plug to each eligible customer who is new to OhmConnect. To participate, you must be a residential electric service account holder outside of (i) areas served by California utilities Pacific Gas & Electric (PG&E), Southern California Edison (SCE) and San Diego Gas & Electric (SDG&E), (ii) areas served by New York utility Con Edison, and (iii) areas in the State of Texas where residents are able to choose their own energy provider.
Limit one discounted smart plug per participating household. Except where prohibited by applicable law, ALL SALES ARE FINAL.
These Offer Terms for the Promotion incorporate by reference the additional terms and conditions corresponding to OhmConnect’s demand response program, which can be found here:
Use of your selected smart plug may require your agreement to other terms and conditions between you and the manufacturer or licensor of that smart plug.
These Offer Terms are meant to be consistent with and supplementary to the Terms of Service. In the event of any inconsistency or direct conflict between these Offer Terms and the Terms of Service, these Offer Terms will prevail.
Subject to availability, OhmConnect will provide each individual who satisfies the eligibility requirements between August 26, 2022 at 12:00 AM PT and June 30, 2023 at 11:59 PM PT (the “Promotional Period”), including enrolling in OhmConnect’s demand response program, authorizing your utility usage data to be shared with OhmConnect and becoming an active OhmConnect user within 30 days of creating your OhmConnect account. The available smart plugs are either one (1) OhmPlug or one (1) TP-Link smart plug. While supplies last.
The Promotion cannot be combined with any other OhmConnect promotions or offerings. OhmConnect reserves the right, at its sole discretion, to suspend, modify or terminate the Promotion for any reason or for no reason. All information collected by OhmConnect in connection with the Promotion will be collected and used in accordance with the Privacy Policy.
To be eligible for the Promotion, you must satisfy all of the following conditions and steps:
To reserve your discounted smart plug, you must satisfy steps 1-4 on or before June 30, 2023 at 11:59 PM PT and within 30 days of creating your OhmConnect account. You also must satisfy step 5 within 30 days of delivery of your smart plug.
Step 1:
Set up an OhmConnect Account. You must become a first-time, fully enrolled customer of OhmConnect. To do so, visit the OhmConnect offer page and create a new OhmConnect account by providing your email address, zip code, first name, and phone number and creating a password. To become an OhmConnect customer, you must agree to the OhmConnect Terms of Service.
Step 2:
Provide a Credit Card: ou must furnish OhmConnect with a valid credit card and provide your authorization for us to charge your card for the full MSRP of the smart plug plus applicable sales tax. At this step, we will charge your credit card $9.99 for the smart plug plus applicable sales tax, which will be calculated after you provide your shipping address in Step 3. You will be charged the full $11.99 or $13.99 MSRP (less the $9.99 amount and sales tax already paid) if you fail to connect the smart plug to OhmConnect within 30 days of delivery of the smart plug to the shipping address provided in Step 3. Before proceeding to Step 3, your utility must confirm that sharing has been authorized. Depending on your utility’s authorization process, this may take anywhere from 2 minutes to several weeks, although the average time is approximately 10 minutes.
Step 3:
Provide a Shipping Address: Provide a shipping address to where the smart plug will be shipped.
Step 4:
Become an Active OhmConnect User: You must complete a qualifying activity to become an active user before the end of the Promotional period and within 30 days of creating your OhmConnect account. A “qualifying activity” means: (a) logging into your OhmConnect account, (b) purchasing an item from the OhmConnect store, (c) connecting a new device to OhmConnect’s demand response program for the first time, or (d) inviting new members to join OhmConnect’s demand response program.
Step 5:
Connect Your Smart Plug: You must connect the smart plug to your OhmConnect account within 30 days of delivery. Instructions for how to install and connect to OhmConnect will be provided with the smart plug.
You are solely responsible for purchasing, maintaining and using at your own expense all utility, Wi-Fi, access to the internet, communications and other equipment and devices necessary to participate in the Promotion.
Employees, officers and directors of OhmConnect, its parent, subsidiaries, and affiliated companies, advertising, promotion, and production agencies, Webmasters and Web suppliers, their immediate family members (parents, grandparents, children, siblings, and spouse of any of the foregoing) regardless of where they live and individuals residing in their same household, whether related or not, are not eligible to participate in the Promotion.
Use of automated, robotic, programmed and like methods of online participation are prohibited. Persons who tamper with or abuse any aspect of the Promotion, as determined by OhmConnect in its sole discretion, will be disqualified. OhmConnect may also prosecute such persons to the full extent of the law.
From time to time, OhmConnect may change these Offer Terms. If it does so, the “Last Updated” line above will be revised. You are responsible for regularly reviewing these Offer Terms. Your continued participation in the Promotion following the posting of changes to the Offer Terms indicates your acceptance of those changes. OhmConnect also reserves the right at its sole discretion to suspend, modify or terminate the Promotion for any reason or for no reason.
